Terms and Conditions

 

The Client agrees that he/she is responsible for all parties involved with the agreed upon photo session. If there is an individual involved in the photo session who does not agree to the terms and conditions the Client assumes responsibility for any liability.

At all times during a photography session with MISS ANGELA PHOTOGRAPHY, in any location, where a child or baby in involved, the responsibly of the child or baby is that of their parent or guardian.

These terms and conditions are published to provide the CLIENT with exactly what is involved in a session with Miss Angela Photography (hereafter “the PHOTOGRAPHER”). Please read all information carefully. All information provided to the PHOTOGRAPHER during the booking process will be used for records, will be kept strictly confidential and will not be shared to any third parties.

These terms and conditions are for services and products related to a photography session plus providing of digital files + product (hereafter “session” or “the assignment”)

The CLIENT authorises the PHOTOGRAPHER to arrange the photography in accordance with the details specified in writing prior at time of booking.

When booking a session with the PHOTOGRAPHER, the CLIENT agrees and understands the PHOTOGRAPHERS pricing and agrees to pay for their session prior to receiving any product (digital or physical), which has been confirmed for their assignment.

The session fee covers the PHOTOGRAPHER’S time and talent, detailed editing of at least 20 images, and secures your session date and current prices. 

The session fee includes photography of up to 5 people, extra people to be photographed will incur a fee.

High resolution digital files are included in the price. Extra digital files and products are available for purchase.

 

The deposit, once paid, is not refundable but may be transferable.

The price quoted will be guaranteed for seven days otherwise the current price will be confirmed when the booking is confirmed

Any additional costs will be advised and confirmation required before proceeding.

 

Should PHOTOGRAPHER not be available for the session for any reason, the PHOTOGRAPHER will notify the CLIENT of the change as soon as it is known and reschedule to a time that suits both parties.

 

Should the CLIENT need to postpone or cancel the session, please do so with at least 24 hours notice where possible. Rescheduled sessions will be made available at the PHOTOGRAPHERS discretion.

 

Travel incurs a fee. Prices to be confirmed at booking.

The PHOTOGRAPHER will not be held responsible for the behaviour of children on the day. eg. tantrums, or any behaviour making it impossible to photograph. The PHOTOGRAPHER will not offer a cancellation or reschedule, unless the CLIENT pays for another session.

 

To avoid disruption to the photographic coverage and to allow the PHOTOGRAPHER to fulfil her contracted duty; other photography by family/friends at this time is not permitted.

After the session, the PHOTOGRAPHER will select final images to provide to the CLIENT. The final digital images are provided via digital download

 

Care and time is taken to process each image. Processing times depend on current work demands. In most cases images will be provided within 4-6 weeks of the session. If uncontrollable circumstances prevents this from taking place the PHOTOGRAPHER must inform the CLIENT as soon as possible.

 

 

The PHOTOGRAPHER will perform post-processing or digital image editing services on the photos and the PHOTOGRAPHER will not provide the CLIENT with original RAW files.

All orders shall remain the property of the PHOTOGRAPHER until full payment has been made.

 

 

The PHOTOGRAPHER agrees to license photos from the session to the CLIENT. All photos delivered to CLIENT are licensed for CLIENT’S personal use only and may be printed using a company of their choice. The PHOTOGRAPHER will not be responsible for poor quality images printed through cheap labs. Images ordered through the PHOTOGRAPHER are sent to a professional digital lab ensuring the best quality printing. 

 

The PHOTOGRAPHER retains the copyright to the images provided.

 

Print- screening images from website or facebook page is unlawful.

The CLIENT obtains images for personal use only, and may not sell the images. Personal use includes sharing images to family and friends. If CLIENT is obtaining images for newspaper announcement or website use, the PHOTOGRAPHER allows the CLIENT to do so, with reference of the photographer adjacent to the photograph.

 

The PHOTOGRAPHER will deliver products and digitals in a reasonable amount of time after the CLIENT has made a final order, depending on estimated delivery times from print companies. The PHOTOGRAPHER will keep the CLIENT informed as best possible.

The digital files remain the property of the PHOTOGRAPHER and will be kept on file a period of two years, after which time the PHOTOGRAPHER will archive the digital files.

 

The PHOTOGRAPHER has no control over the environment in which the photographs are kept and that colour photographs, in common with all sensitised material and colour dyes, have limited life expectancy which is minimised when exposed to strong and prolonged sunlight, heat or fluorescent light sources. Photographs will last longer if displayed under better lighting conditions.

 

The CLIENT will make full payment within 30 days of the PHOTOGRAPHER

providing an invoice or payment details, unless a payment plan has been arranged with the PHOTOGRAPHER.

Payment plans will ONLY be agreed upon if client has requested one prior to the session.

Should the CLIENT require a second copy of their images for any reason, the CLIENT will pay a replacement fee of $50.00. This is Non-negotiable.

 

CLIENT will pay all reasonable freight and postage if they so request.

All orders must be confirmed in writing and accompanied by full payment unless payment plan has been arranged with the PHOTOGRAPHER.T Telephone orders require written confirmation with payment before the order can be processed.

 

Should the CLIENT fail to pay and collect any order within fourteen (14) days of notification of completion, the order shall be in default and the PHOTOGRAPHER shall charge a default charge of 1.5% per month (18% annual rate) on the unpaid balance (minimum monthly charge of $5.00). In addition, no future orders will be processed until the Order is paid in full.

The CLIENT will hold PHOTOGRAPHER harmless for any damage, personal injury, or loss caused by tripping over or otherwise being injured from any equipment, furniture or such at the PHOTOGRAPHERS studio or the PHOTOGRAPHER has on location. If the CLIENT has a session at 27 Military Rd, Avondale Heights the CLIENT agrees to enter at their own risk. The CLIENT further agrees to hold PHOTOGRAPHER harmless for any personal injury which may occur as the CLIENT poses or works with PHOTOGRAPHER.

The CLIENT agrees to indemnify and hold harmless PHOTOGRAPHER for any liability, damage, or loss related to technological failure. Cameras, hard drives, and memory cards are subject to technical failure. PHOTOGRAPHER will take reasonable steps to prevent data loss, but is not liable for loss of data due to technical failure.

 

The PHOTOGRAPHER shall carry out this assignment with due and professional diligence.

Elements beyond the PHOTOGRAPHER’s control include faulty material, equipment failure, loss of digital files, civil disturbances, or weather conditions which may inhibit or prevent the PHOTOGRAPHER completing in whole or in part this assignment. In this case the PHOTOGRAPHER shall not be liable for its complete performance of the assignment. It is agreed that the liability of the PHOTOGRAPHER shall be limited to be a refund of any money paid under the agreement which shall be in full & final satisfaction of any damage or loss suffered.

The CLIENT agrees that the PHOTOGRAPHER owns the Copyright in all photographs and grants permission to the PHOTOGRAPHER to use any image from the session for industry competitions and as required subsequent usage and for reasonable general promotional advertising for the PHOTOGRAPHER. For example in any and all forms of media for commercial purposes, advertising, trade, on the PHOTOGRAPHERS website, promotional material, literature and social media.
